TERMS AND CONDITIONS FOR RAVENSMS

(ANDROID APPLICATION)

1. DEFINITIONS

  1. "Developer," "we," "us," or "our" refers to the creators, designers, programmers, and affiliated entities responsible for the RavenSMS application.
  2. "Application," "App," or "Software" means the RavenSMS Android application and all associated services, code, and intellectual property.
  3. "User," "you," or "your" refers to any individual or entity accessing, installing, or using the Application.
  4. "Content" includes text, messages, images, data, or materials transmitted through the Application.

2. ACCEPTANCE OF TERMS

  1. By installing or using the Application, you affirm that:
    1. You have read, understood, and agree to be bound by these Terms;
    2. You are of legal age in your jurisdiction or have obtained parental/guardian consent;
    3. You comply with all applicable laws and regulations.
  2. The Application’s functionality is described on its official distribution platform. Continued use constitutes acceptance of future amendments to these Terms.

3. DATA PRACTICES

  1. Data Collection
    1. The Developer disclaims all liability for data collection by third-party libraries, services, or distribution platforms.
    2. The Application does not intentionally collect, store, or transmit personal data beyond your device.
  2. Connection Statistics
    1. You consent to transmission of non-personal technical data to facilitate Application functionality.
  3. Contacts Permission
    1. Access to contacts is used solely for Application operations. Contact data is not stored or shared externally.
  4. Content Responsibility
    1. You are solely liable for sharing Content without sender consent. Developer disclaims liability for misuse.

4. USER-GENERATED CONTENT

  1. No Monitoring. Developer does not:
    1. Prescreen content
    2. Maintain message archives
  2. Emergency Services
    1. Not replacement for 911/equivalent emergency services

5. MESSAGE HANDLING & ENCRYPTION

  1. Content Responsibility
    1. Users bear sole responsibility for forwarding/sharing messages without sender consent
    2. Recommend against saving, printing, or sharing messages without explicit permission
  2. Encryption Limitations
    1. No liability for encryption failures including:
      1. Obsolescence of cryptographic methods
      2. Lost encryption keys
      3. Design flaws or implementation errors
    2. Users must maintain backups of encryption keys or passwords
  3. Message Integrity
    1. No responsibility for:
      1. Content alterations during processing
      2. SMS storage failures
      3. Delayed/corrupted timed messages
      4. Undelivered notifications
  4. Message Modification Rights
    1. Users acknowledge senders may delete/alter received messages per application features

6. TECHNICAL LIMITATIONS

  1. Network Reliance
    1. No control over SMS delivery via cellular networks
    2. Delivery times approximate, not guaranteed
  2. Security Vulnerabilities. Users must:
    1. Install security updates promptly
    2. Report vulnerabilities to dev.ravensms@gmail.com

7. USER OBLIGATIONS & PROHIBITED USE

  1. You agree to use the Application in compliance with all applicable laws.
  2. Prohibited activities include:
    1. Harassment, defamation, or threats
    2. Spam, phishing, fraudulent activity, or criminal preparation
    3. Unauthorized communication with minors
    4. Reverse engineering or unauthorized distribution
  3. Security Disclaimers:
    1. Developer disclaims liability for MITM attacks, data interception, or Third-party code vulnerabilities
    2. No responsibility for lost encryption keys, corrupted messages, or network operator errors

8. ADDITIONAL PROTECTIONS & DISCLAIMERS

  1. Age Compliance
    1. Users under 13 (or 16 in EU) prohibited per COPPA/GDPR
    2. Parents must monitor minor usage under Family Educational Rights and Privacy Act (FERPA)
  2. Third-Party Services
    1. No liability for Google Play Services/SMS carrier disruptions
    2. API changes may affect functionality without notice
  3. Force Majeure. Exempt from liability for service interruptions due to:
    1. Natural disasters
    2. Government restrictions
    3. ISP/carrier outages

9. INTELLECTUAL PROPERTY

  1. The Application and all associated IP remains exclusive property of the Developer.
  2. Copying, modifying, or distributing the Application without consent is prohibited.
  3. Restrictions (Prohibited actions include):
    1. Reverse engineering or protocol replication
    2. Unauthorized distribution/sales
    3. Interface/code modifications

10. SOFTWARE MAINTENANCE

  1. Automatic Updates
    1. App may auto-update without notice
    2. Legacy versions become unsupported after 6 months
  2. Beta Features
    1. Experimental features may be withdrawn without notice

11. PAYMENTS & REFUNDS

  1. Transactions processed via Google Play Billing; refunds subject to Google's policies.
  2. Tax compliance managed through Google's systems.

12. WARRANTIES & DISCLAIMERS & LIABILITIES

  1. No Guarantees. Service provided "as is" without warranties of:
    1. Uninterrupted operation
    2. Error-free performance
    3. Compatibility with all devices
    4. Merchantability or fitness
  2. Developer not liable for:
    1. Data loss or business interruptions
    2. Third-party actions or force majeure events
  3. Indemnification. Users agree to defend and hold harmless Developer from claims arising from:
    1. Content violations
    2. Device damage from misuse
    3. Regulatory non-compliance

13. TERMINATION

  1. Developer reserves right to terminate access for Terms violations.

14. GENERAL PROVISIONS

  1. Export Compliance. Users certify compliance with:
    1. U.S. Export Administration Regulations (EAR)
    2. International Traffic in Arms Regulations (ITAR)
  2. Class Action Waiver
    1. Claims must be brought individually, not as class actions
  3. Survival Clause
    1. Key obligations (indemnification, IP rights) persist post-termination

15. GOVERNING LAW

  1. These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law principles.
  2. Users must comply with local cryptography laws
  3. Disputes resolved through binding arbitration.
  4. Any legal action arising from these Terms shall be brought exclusively in the courts of Franklin County, Ohio, or the United States District Court for the Southern District of Ohio.

16. AMENDMENTS

  1. Developer may update Terms at any time; continued use constitutes acceptance.
